Das deutsche Umsatzsteuersystem ist sicherlich kompliziert. Nun stelle man sich aber ein Umsatzsteuerrecht vor, welches sich von Bundesland zu Bundesland unterscheiden kann. Die Vereinigen Staaten von Amerika bestehen aus 50 Bundesstaaten und dem District of Columbia und jeder dieser Bundesstaaten kann sein eigenes Umsatzsteuerrecht bestimmen und die Umsatzsteuer (Sales & Use Tax) souverän festsetzen. Innerhalb des Bundesstaates kann sich zudem die Höhe der Umsatzsteuer von County zu County (in Deutschland mit dem Landkreis vergleichbar) unterscheiden, welches den Sachverhalt noch weiter verkompliziert.
Eine einheitliche Besteuerung auf Bundesebene - vergleichbar mit Deutschland - findet somit in den USA nicht statt.
Zu unterstellen, dass das Steuerrecht in den USA anlog des deutschen Steuerrechts aufgebaut ist, wäre ein Fehler, der teuer werden kann. Wenn man im Bereich der Umsatzsteuer einmal auf die Intention des Gesetzgebers schaut, so sind sicherlich Parallelen zwischen Deutschland und den USA zu erkennen: beide Länder wollen den finalen Endnutzer mit Umsatzsteuer belasten und nicht den Zwischenhändler oder Hersteller.
In Deutschland ist dies durch den Vorsteuerabzug gelöst, da der Unternehmer die ihm in Rechnung gestellte Umsatzsteuer als Vorsteuer wieder geltend machen kann und somit die Steuer für ihn einen durchlaufender Posten darstellt. Gerade diesen Vorsteuerabzug findet man in den USA auf Bundesstaatenebene jedoch nicht wieder...
